Pre Bankruptcy Planning
If you’re in the beginning stages of researching or finding a Michigan bankruptcy attorney or Michigan Bankruptcy lawyer you can start by gathering the following documents listed below. These documents are required when filing bankruptcy, if you do not have them at your 341 hearing or Meeting of the creditors your bankruptcy case could be delayed or dismissed. The documents are needed for each person filing. If you and your spouse are filing together you need to provide each document as it pertains to the individual (SSN card, D.L)
Gather the following Bankruptcy documents prior to filing or meeting with your attorney.
1) Drivers License or State I.D.
2) Social Security Card ( or something with your SSN number)
3) Two years of Tax returns.
4) Titles for vehicles owned or buying (vehicles, boats, RV’s etc). If you are leasing you do not own the vehicle. If you do not have a copy of the titles you can pay to receive a copy from the secretary of state.
5) People buying a home or rental property must provide the following documents
- Deed (warranty or quit claim) you can go to your local county office.
- Copy of land contract (L.C.) if house was purchased on L.C.
- Property Tax bill showing SEV ( State Equalized Value)
- Appraisal of Property(if you have one)
6) Divorce judgments if you were recently divorced
7) 6 months of Pay statements or unemployment statements.
8 ) Pension plan documents if you have a pension plan or 401K.
9) 6 Months of all of your bank statements (include children’s accounts if your name is on them).
*** Before you file it is recommended your obtain 2 years worth of all of your credit card statements in the event the US Trustee ( not local trustee) decides to randomly audit your case under presumption of abuse. This is not typical at all. However, the day you file bankruptcy credit card companies and other creditors will cut off access to all of your accounts and will not be helpful if you need these documents.
